I was just wondering what kind of evidence is needed. I am having trouble getting my ex to pay out a loan that i got for him since he was bankrrupt - he keeps pushing his payment dates back.
The problem is that there was no written agreement that the loan was for him and the loan is in my name.
Should I seek legal advice?

To Sam Byrne:

Hi Sam, we are about to go through the same process, I just have a question. How are they 'forced' to pay if you win the court case. The other driver is the driver at fault and they are ignoring all our letters and calls. I am afraid they will then ignore the court order to pay and I don't now what to do after that.

I have been through the exact process you describe here after a Taxi driver failed to assume responsibility for an accident he caused damaging my car. The exact procedures above were followed and we ended up in court.

I won the case because I had all the evidence and went in well prepared without having to pay for a lawyer. The taxi driver was forced to pay all costs to fix my car and all costs that I spent chasing him through to court.

Good advice in this blog - it is exactly what I went through - and its an experience well worth it. It's a great system that allows individuals to chase other individuals if they feel that they are owed.

If you have the evidence I recommend go for it and do not let anyone get away with not paying you what they owe you. Never think that it is too hard. It is actually a great experience going through the process and most of all, victory is very sweet.
